Update 3 - OII passes 60-day point in Clark County Sheriff’s Office use of deadly force investigation

Olympia, Wash. (July 11, 2025)- The Washington State Office of Independent Investigations (OII) is just past 60 days into its investigation of a use of deadly force incident that took place Thursday, May 07 in Ridgefield, Wash. By statute, OII is directed to complete its investigations within 120 days or report any delay to the OII Advisory Board.  

The incident under investigation occurred at the Ridgefield Port of Entry, a scale facility on Interstate 5According to the Clark County Sheriff’s Office (CCSO), Deputy Bryson Layton had arrested a man on suspicion of driving under the influence following a traffic collision. The man, later identified by the Clark County Medical Examiner’s Office as Marc Fogle, was transported to the scale house for a breathalyzer exam.  

During that process, CCSO reported Deputy Layton became involved in a physical altercation with Mr. Fogle. According to CCSOMr. Fogle attempted to take Deputy Layton’s firearm, and the deputy then stabbed him several timesMr. Fogle died from his injuries.  

In addition to CCSO, the Ridgefield Police Department and the Cowlitz Tribal Police sent officers to the scene in the immediate aftermath of the incident. OII investigators have collected reports from officers with both departments.  

To date, OII investigators have reviewed more than 60 videos, both body worn camera videos and in-car dash videos. The knife used in the incident was collected and was submitted for testing with the Washington State Patrol Crime Lab. OII investigators have conducted several interviews including with witnesses to the collision. As part of the investigation, a tip line was also established to receive information from the public. One call has been received to date on the tip line.  

An OII family liaison has been assigned to work with the family of Mr. Fogle to ensure they remain informed of the progress of the investigation. The family liaison role serves as a point of contact with impacted family members throughout the OII investigation and can connect family members to any needed and available community resources  

This investigation remains active and ongoing. Once completed, a Final Case Report will be posted to the OII website. No further updates are anticipated until the Final Case Report is completed.
